Judges are ordering counties in New Mexico to issue same sex couples marriage licenses.

Last Friday, Santa Fe county was ordered to do so and today Bernalillo county received a court order from another district judge. Doña Ana county started granting licenses on their own last Wednesday.

Unlike the one county in Pennsylvania, which faces a court hearing on Sept 5th, which I suspect will end with a cease and desist order, as PA law (though not their constitution) limits marriage to opposite sex couples, the state of New Mexico has no such law on their books, either permitting or preventing same sex couples from marrying. Judges are weighing in and the gates have opened for the time being. It will be interesting to see how this particular scenario plays out.
