i've actually read several articles online from folks who say this case may not go all the way up to the supremes. it really depends on the outcome of the appeals court, and what the supreme court thinks of that decision.
although if the idealogical make-up of the court remains as it is today, i would expect that an appeals court verdict striking down prop 8 (or upholding walker's striking down of prop 8) would probably get 5 votes to take the case.
the pro-8 folks have been whining since pre-trial about how walker is unfairly biased against them, so even though his gaiety may not be big news, i expect they'll still try to spin it as further evidence that any decision against them was motivated by his prejudice.
