I am truly amazed by the words judge after judge are putting into their rulings striking down marriage ban and marriage ban. I found the the opinion from Judge Arenda L. Wright Allen, when she struck down the ban in Virginia last February stirring. Opening her opinion was a quote from Mildred Loving made on the 40th anniversary of Loving v. Virginia and she closed 41 pages later with words from Abraham Lincoln. (Google it folks; it's worth reading.) Earlier this week, I posted the conclusion of Judge Michael McShane's ruling overturning the ban in Oregon.

Now I offer you a quote from Judge John Jones, from his ruling in Pennsylvania this past Tuesday. This gentleman is a conservative Republican, recommended by Rick Santorum and nominated to the bench by none other than good old Dubya.

"The issue we resolve today is a divisive one. Some of our citizens are made deeply uncomfortable by the notion of same-sex marriage. However, that same-sex marriage causes discomfort in some does not make its prohibition constitutional. Nor can past tradition trump the bedrock constitutional guarantees of due process and equal protection. Were that not so, our would still be a racially segregated nation according to the now rightfully discarded doctrine of “separate but equal.” … In the sixty years since Brown [v. Board of Education] was decided, “separate” has thankfully faded into history, and only “equal” remains. Similarly, in future generations the label same-sex marriage will be abandoned, to be replaced simply by marriage.

We are a better people than what these laws represent, and it is time to discard them into the ash heap of history."


The ash heap of history! Amen to that! Yes, sometimes even the likes of Rick Santorum and Dubya get it right when they recommend a good man, set on justice and and doing the right thing; for the lesbian and gay community in Pennsylvania, thanks to Judge Jones, the rights of the minority are now protected from the tyranny of the majority.

As a Pennsylvanian, I was delighted to hear about Judge Jones' ruling, but was shocked when I heard that Gov. Corbett was not going to challenge the ruling.

Things are improving.

We have so much work to do here before we even get to the stage of struggling for same-sex marriage...
